Senior Legal Counsel - Support the credit team and credit initiatives in Australia

PayPal Australia is the provider of purchase payment facilities in Australia, primarily supervised by APRA and ASIC. PayPal is looking for a fast-learning, dynamic lawyer to join our legal team.   

The position involves working closely with the business units to support key credit strategic initiatives, particularly the enhancement and development of PayPal credit initiatives, PayPal Working Capital and other finance credit products. Responsibilities include liaising with marketing, commercial development teams, finance, credit risk, product development and other key stakeholders to develop and improve credit products, initiatives and campaigns.

You will work with members of the Australian business to advise on regulatory issues including advising on technical queries on laws and regulations impacting financial services, IT, consumer protection and data privacy, with a particular focus on the National Consumer Credit Protection Act and National Credit Code.  We are looking for an enthusiastic candidate who can apply technical legal constructs contextually and work with the business to find innovative solutions and provide high quality legal advice.

The ideal candidate will be a confident self-starter with strong interpersonal and organizational skills and a demonstrated ability to effectively and proactively provide sound legal advice, exercise good business judgment, work with senior management and implement policies and processes on a cross-functional basis in a fast paced environment.

To succeed in this challenging role, candidates should be mature, self-motivated and well-organised with excellent communication and problem solving skills.  Candidates should also be flexible with a global outlook and collaborative working style.

An ability to work in a matrixed environment with multiple stakeholders is essential. PayPal is a global company and the successful candidate will need to have flexibility to work with and occasionally accommodate colleagues in different time zones (particularly Europe, the United States and Asia).

Core responsibilities:

  • Working with the PayPal business teams to advise on the development and implementation of new products and services, including the regulatory and business risk implications

  • Advising on and negotiating agreements with key partners, payment processors and financial institutions to further the expansion of the PayPal business

  • Dealing with regulatory issues and advising on the impact of new and existing payments laws and regulations and local governance and compliance matters

  • Maintaining and updating the PayPal User Agreement, Privacy Policy and other documentation

  • Working with teams across the business including Marketing in developing new campaigns

  • Helping to develop and build the wider, non-legal team’s understanding of relevant laws and regulations in a creative and engaging way, to encourage a culture of compliance and responsibility.

Job Requirements:

  • Admitted as a solicitor with at least 10 year’s post-admission experience gained in a law firm or as in-house counsel

  • At least 5 years’ experience in consumer credit and a strong understanding of relevant consumer credit law and regulations in Australia is essential

  • Experience in banking, payments, financial services or fintech would be desirable

  • Ability to collaborate with senior management and cross functional stakeholders

  • Confident self-starter with a keen attention for detail and an ability to manage multiple tasks and projects simultaneously.

  • Creative thinker with strong problem-solving skills and the ability to stay calm under challenging circumstances

  • Ability to handle multiple assignments simultaneously, with effective resolution of conflicting priorities

  • Ability to thrive in a fast-paced, changing environment and matrixed organisation

  • Flexibility to work with colleagues in Europe, the United States and Asia and accommodate calls and deadlines aligned to their time zones
