PayPal provides services to customers in the EU through PayPal (Europe), a PayPal, Inc. subsidiary, licensed and regulated as a bank in Luxembourg, as well as in Russia and throughout APAC through other license-passporting arrangements. This position will provide world-class privacy and data protection related legal advice and regulatory support to PayPal throughout the EMEA region as a member of the Global Legal Privacy team.

Role:

This position will work as a member of the Global Legal Privacy team to deliver legal advice on data protection and privacy laws throughout the EMEA region, with special emphasis on financial privacy law.  As legal counsel, this position will also partner closely with the European legal team on bank secrecy issues affecting the banking operations of PayPal S.à r.l. et Cie, S.C.A (“PayPal Europe) and will provide legal counsel to, and work in close partnership with, PayPal’s Data Protection Officer and PayPal’s Global Privacy Program Office.


Location and Reporting:

This position will be based in one of PayPal’s major European offices (London, Luxembourg or Berlin) and will report directly to the Head of Global Legal Privacy in San Jose, California.


Responsibilities:

As EMEA Data Protection and Privacy Counsel, this position will be principally responsible for:

  • Leading and supervising the PayPal legal privacy team in the EMEA region, including supporting their ongoing development and integration within the global PayPal legal function;
  • Providing legal advice on applicable privacy requirements to the EU DPO and the Global and regional Privacy Program Offices, and
  • Serving as a key subject matter expert and advisor to PayPal’s legal counsels, and advising key functional areas and regional business units on privacy requirements.

Skills and Experience: This position will be asked to demonstrate experience and competence by:

  • Working autonomously as a leader, as well as part of multiple teams, as a collaborator and advisor.
  •  Leading, coaching and mentoring colleagues and team members to enhance individual and enterprise growth and success.
  • Managing the development, implementation, maintenance, and monitoring of public-facing privacy policies and other user disclosures and consents for compliance, accuracy, and clarity.
  • Reviewing and providing legal advice on new and enhanced products, services, technology, marketing communications, and new business initiatives.
  • Drafting and negotiating privacy and data protection-related provisions of complex commercial and technology contracts, including for strategic business partnerships, outsourcing, data processing, joint ventures, M&A transactions and business dispositions.
  • Identifying and bringing enterprise-wide privacy and data protection-related risks to the attention of the EU DPO and Global Privacy Office.
  • Providing training to legal colleagues to help them advise their clients on how to design products and services that comply with PayPal’s Privacy Principles and reflect organizational privacy and security requirements.
  • Creating and delivering legal training and enhancing awareness of privacy and data protection laws for other members of the Legal Team.
  • Understanding and advising on the legal aspects of complex data flows across the data lifecycle.
  • Contributing legal privacy expertise as part of due diligence activities around business partners, services providers and other partnerships and ventures.
  • Collaborating and coordinating with government relations teams to proactively monitor and review privacy and data-protection related legislation in order to ensure accurate and up-to-date rosters of all legal obligations.
  • Serving as a legal representative in privacy and data protection-related organizations.
  • Establishing and maintaining collaborative relationships with, and providing legal subject matter expertise to, global cross-functional teams.
  • Demonstrating in-depth knowledge of cutting edge technology issues and their privacy and data protection implications with emphasis on mobile technologies and mobile payments.

Qualifications:

  • Fully qualified / licensed lawyer, EU country qualification strongly preferred.
  • Fluency in English; additional fluency in German or French preferred.
  • Direct legal experience actively advising international and preferably global businesses with strong EU presence on privacy and data protection issues.
  • Experience as in-house counsel preferred, particularly in highly matrixed corporate structures.
  • Managerial experience.
  • CIPP/E or other privacy certifications desirable
  • Experience advising clients in the financial services, mobile payments, internet and technology industries preferred.
  • M&A experience and experience advising on integration of new business units desirable.
